of the State Finance and Procurement Article.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
take effect June 1, 1989.

AN ACT concerning

Personal Injury Actions - Limitation on Noneconomic
Damages - Jury Trials

FOR the purpose of prohibiting juries in certain actions from
being informed of a certain limitation on certain damages;
requiring a court to reduce the amount of a jury award under
certain circumstances; providing for the applicability of
this Act; and generally relating to awards for noneconomic
damages in personal injury actions.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

11-108.

(a) In this section:

(1)  "Noneconomic damages" means pain, suffering,
inconvenience, physical impairment, disfigurement, loss of
consortium, or other nonpecuniary injury and;

(2)   "Noneconomic damages" does not include punitive
damages.
