8-210. AUTHORITY OF SECRETARY.

THE BOARD EXERCISES ITS POWERS, DUTIES, AND FUNCTIONS
SUBJECT TO THE AUTHORITY OF THE SECRETARY.

REVISOR'S NOTE: This section is new language derived
without substantive change from former Art. 56, § 528.

The former reference that narrowly limited the
Secretary's authority to the powers and duties of the
Board "vested ... by this subtitle" is deleted as
misleading. Presumably, the powers and duties of the
Board wherever codified are to be subject to the
authority of the Secretary.

particular, Art. 41, §§ 8-101 through 8-106 of the
Code.

SUBTITLE 3. LICENSING.

8-301. LICENSE REQUIRED; EXCEPTIONS.

(A)   IN GENERAL.

EXCEPT AS OTHERWISE PROVIDED IN THIS TITLE, AN INDIVIDUAL
SHALL BE LICENSED BY THE BOARD BEFORE THE INDIVIDUAL MAY PROVIDE
HEARING AID SERVICES.

(B)  EXCEPTIONS.

THIS SECTION DOES NOT APPLY TO AN INDIVIDUAL WHO IS FITTING
HEARING AIDS UNDER:

(1)  AN ACADEMIC CURRICULUM OF AN ACCREDITED
INSTITUTION OF HIGHER EDUCATION; OR

(2)  A PROGRAM CONDUCTED BY:

(I)  A CHARITABLE ORGANIZATION;

(II)  A NONPROFIT ORGANIZATION THAT IS SUPPORTED
PRIMARILY BY VOLUNTARY CONTRIBUTIONS; OR
