(D)  RESTRICTIONS ON CONSUMER MEMBER.

WHILE A MEMBER OF THE BOARD, A CONSUMER MEMBER MAY NOT:

(1)  HAVE A FINANCIAL INTEREST IN OR RECEIVE
COMPENSATION FROM A PERSON REGULATED BY THE BOARD; OR

(2)  GRADE ANY EXAMINATION GIVEN BY OR FOR THE BOARD.

(E)  OATH.

BEFORE TAKING OFFICE, EACH APPOINTEE SHALL TAKE THE OATH
REQUIRED BY ARTICLE I, § 9 OF THE MARYLAND CONSTITUTION.

(F)  TENURE; VACANCIES.

(1)  THE TERM OF A MEMBER IS 5 YEARS AND BEGINS ON
JULY 1.

(2)  THE TERMS OF MEMBERS ARE STAGGERED AS REQUIRED BY
THE TERMS PROVIDED FOR MEMBERS OF THE BOARD ON OCTOBER 1, 1989.

(3)  AT THE END OF A TERM, A MEMBER CONTINUES TO SERVE
UNTIL A SUCCESSOR IS APPOINTED AND QUALIFIES.

(4)  A MEMBER WHO IS APPOINTED AFTER A TERM HAS BEGUN
SERVES ONLY FOR THE REST OF THE TERM AND UNTIL A SUCCESSOR IS
APPOINTED AND QUALIFIES.

(G)  REMOVAL.

THE GOVERNOR MAY REMOVE A MEMBER FOR INCOMPETENCE OR
MISCONDUCT.

REVISOR'S NOTE: Subsections (a)(1), (2)(i), (ii)2 through
4, (iii), and (iv), (3), and (4), (b), and (f)(1) of
this section are new language derived without
substantive change from the second sentence of former
Art. 56, § 523(a), the first through fifth sentences
of (b), and the second sentence of (c).

Subsection (a)(2)(ii)l of this section is new language
added to conform to the practice in appointing the
audiologist member since the enactment of a licensing
law for audiologists.

Subsections (c) and (d)(2) of this section are new
language that repeats the provisions of present Art.
41, § 8-102(d) and (e) and the second sentence of (c).

Subsection (d)(1) of this section is standard language
added as an inherent and essential corollary to
subsection (c)(4) of this section.
