AN ACT concerning
Home Improvement Commission - Payment of Claims Maryland Program
Evaluation Act
FOR the purpose of permitting the payment of consequential damage
from the Home Improvement Guaranty Fund for damages to a
homeowner's home or personal property caused by certain home
improvements; altering a certain definition; permitting the
recovery of damages caused by a home improvement
contractor's failure to comply with, or failure to use
materials that comply with, State and local building codes;
clarifying that "home improvement" includes the
construction, replacement, or improvement of roofs;
authorizing a court of competent jurisdiction to assess
against an unlicensed home improvement contractor an amount
equal to the damages incurred by a homeowner as a result of
certain home improvements performed by that unlicensed
contractor; limiting the maximum amount of that assessment;
providing for the transfer of a portion of that assessment
to the Fund for reimbursement by the Home Improvement
Commission to the homeowner who incurred the damages;
authorizing the Commission to review and amend or reverse
certain orders issued on or after a certain date and to pay
from the Fund before a certain date to an aggrieved
homeowner certain damages previously denied; providing for
the subrogation of the Commission for certain claims for a
certain period; providing for the severability of this Act;
and generally relating to the award and payment of damages
for violations of the Maryland Home Improvement Law.
FOR the purpose of altering the date for the review of the
Maryland Home Improvement Commission under the Maryland
Program Evaluation Act; and generally relating to the
evaluation of the Maryland Home Improvement Commission under
the Maryland Program Evaluation Act.
BY repealing and reenacting, with amendments,
