SERVICE; AND

WILLIAM DONALD SCHAEFER, Governor Ch. 570
(I) HAS AT LEAST 16 YEARS OF CREDITABLE

(II) ELECTS TO HAVE THE MEMBER'S ACCUMULATED
CONTRIBUTIONS PAID AS AN ANNUITY OF EQUIVALENT ACTUARIAL VALUE
INSTEAD OF WITHDRAWING THE ACCUMULATED CONTRIBUTIONS.

(C) A MEMBER QUALIFIES FOR A PENSION UNDER PARAGRAPH
(B) OF THIS SUBSECTION IF THE MEMBER:

(I)1. IS AN ELECTED OR APPOINTED OFFICIAL OF
THE STATE AT THE TIME OF APPLICATION FOR RETIREMENT; AND

2. WAS INITIALLY AN ELECTED OR APPOINTED
OFFICIAL OF THE STATE BEFORE JULY 22, 1981;

(II) 1. IS AN ELECTED OR APPOINTED OFFICIAL
THE STATE AT THE TIME OF TERMINATION OF SERVICE;

OF

2. WAS INITIALLY AN ELECTED OR APPOINTED
OFFICIAL OF THE STATE DURING THE PERIOD FROM JULY 22, 1981
THROUGH JUNE 30, 1982, BOTH INCLUSIVE; AND

3. THE TERMINATION OF SERVICE IS
INVOLUNTARY, AS CERTIFIED BY THE SECRETARY OF PERSONNEL; OR

(III) 1. WAS PROMOTED
POSITION ON OR BEFORE JUNE 30, 1982;

TO

AN

UNCLASSIFIED

2. HAS BEEN IN THE UNCLASSIFIED SERVICE
OF THE STATE CONTINUOUSLY FROM JUNE 30, 1982 UNTIL THE TIME OF
TERMINATION OF EMPLOYMENT; AND

3. THE TERMINATION OF EMPLOYMENT IS
INVOLUNTARY, AS CERTIFIED BY THE SECRETARY OF PERSONNEL.

(D) If [the] A beneficiary WHO RETIRES AS AN ELECTED
OR APPOINTED OFFICIAL UNDER THIS SUBSECTION is appointed or
elected to any office IN THE EXECUTIVE BRANCH, the salary or
compensation of which is paid by the State, [his] THE retirement
allowance shall cease, [he] THE BENEFICIARY may become a member
of this pension system again, and shall contribute in accordance
with this subtitle. Any creditable service at the time of [his]
retirement shall be restored, and in addition, on [his]
subsequent retirement [he] shall be credited with all [his]
service as a member, if [his] THE allowance on the subsequent
retirement does not exceed the allowance [he was receiving]
RECEIVED before restoration plus the allowance that has accrued
on account of [his] creditable service EARNED after restoration.
The payment of all these allowances and the continued payment of
these allowances shall be contingent on the State of Maryland
paying each year the additional amount required to meet the
current disbursements of these allowances.
