Ch. 540

LAWS OF MARYLAND

Act, effective July 1, 1989, without any change or loss of
rights, benefits, entitlements, or status, including, if any,
merit system and retirement status, except as otherwise
specifically provided in this Act. Upon termination of employment
of any incumbent in a management position in the Office of
Planning who is transferred under the provisions of this Act, the
Department of Personnel shall reevaluate the position and, if
necessary, make an appropriate reclassification by consistent with
the recognition that the position is employed by an agency rather
than by a department.

SECTION 4. AND BE IT FURTHER ENACTED, That every person
who, as of June 30, 1989, is employed by the Department of State
Planning in a position abolished by this Act and who, effective
July 1, 1989, is transferred to the same or a substantially
similar position with the Department of Budget and Fiscal
Planning or the Office of Planning shall transfer without any
change or loss of rights, benefits, entitlements, or status,
including, if any, merit system and retirement status, except as
otherwise specifically provided in this Act.

SECTION 5. AND BE IT FURTHER ENACTED, That, except as
otherwise expressly provided in this Act, nothing in this Act
affects the term of office of an appointed member of any board,
commission, committee, or other agency or unit, and a person who
is a member of such a unit on the effective date of this Act
shall remain a member of that unit or, as the case may be, shall
become a member of any successor unit for the balance of the term
to which the person was appointed, unless the person sooner dies,
resigns, or is removed pursuant to law.

SECTION 6. AND BE IT FURTHER ENACTED, That, except as
expressly provided to the contrary in this Act, any transaction
affected by or flowing from any statute here amended, repealed,
or transferred, and validly entered into before the effective
date of this Act and every right, duty, or interest flowing from
it remains valid after the effective date of this Act and may be
terminated, completed, consummated, or enforced pursuant to law.

SECTION 7. AND BE IT FURTHER ENACTED, That, except as
otherwise provided in this Act, all permits and licenses,
applications for permits and licenses, rules and regulations,
proposed rules and regulations, standards and guidelines, orders
and other directives, forms, plans, memberships, special funds,
appropriations, grants, applications for grants, contracts,
property, investigations, administrative and judicial
proceedings, rights to sue and be sued, and all other duties and
responsibilities associated with those functions transferred by
this Act shall continue in effect under the Secretary of Budget
