Ch. 524                                           LAWS OF MARYLAND

3.  THAT HAS WAITER OR WAITRESS SERVICE TO
ITS CUSTOMERS WHO ARE SEATED AT TABLES FOR DINING; AND

4.  THAT IS NOT CONSIDERED TO BE A
FAST-FOOD STYLE FACILITY.                                                          

(4)  A CLASS B BEER, WINE AND LIQUOR LICENSE
AUTHORIZES THE HOLDER TO SELL BEER, WINE AND LIQUOR. BY THE DRINK
FOR CONSUMPTION ON THE LICENSED PREMISES ONLY.

(5)  THIS LICENSE DOES NOT HAVE OFF-SALE PRIVILEGES.

(6)  THE REQUIREMENTS FOR HOURS AND DAYS OF SALE ARE
AS PROVIDED UNDER SECTION 91(A) AND (B) OF THIS ARTICLE.

(7)  THE ANNUAL LICENSE FEE IS $750.

(8)  THIS CLASS B BEER, WINE AND LIQUOR LICENSE IS
EXEMPT FROM ANY LICENSE POPULATION QUOTA LIMITATION.

(9)  NOTWITHSTANDING ANY LAW TO THE CONTRARY, THIS
LICENSE MAY NOT BE TRANSFERRED TO A LOCATION OTHER THAN THE
PREMISES FOR WHICH IT WAS ISSUED.

45.

(c) Except for clubs and hotels AND MOTELS, no license
shall be issued for premises which do not front upon a public
street, and no blind or obstruction shall be allowed or permitted
which may obstruct the view of persons passing along said street
from a full view of such licensed premises.

91.

(a)  In Allegany County, any person having a license under
this article may not sell intoxicating beverages between the
hours of 2 a.m. and 7:00 o'clock a.m. except as provided in
subsection (b), it shall be unlawful after 2:00 a.m. Sunday to
sell intoxicating beverages until 7:00 o'clock a.m. Monday.
However, Sunday sales when New Year's Eve or New Year's Day falls
on Sunday shall be governed by § 89(i) of this article.

(b)  (1) In Allegany County, notwithstanding any other
provisions of this subtitle, holders of Class B and Class D
licenses which are restaurants as defined in paragraph (2) of
this subsection, HOLDERS OF CLASS B LICENSES WHICH ARE ISSUED FOR
USE IN A RESTAURANT OR BANQUET ROOM LOCATED WITHIN A HOTEL OR
MOTEL AS PROVIDED UNDER SECTION 19(B) OF THIS ARTICLE, and
holders of Class-C licenses, may, if they pay an additional fee
of $250, sell alcoholic beverages for consumption on the premises
only on Sunday between the hours of 1 p.m. and 2 a.m. Monday.
