AN ACT concerning

Maryland Public Broadcasting Commission - Private Fund-Raising

FOR the purpose of authorizing the Maryland Public Broadcasting
Commission to promote certain fund-raising; providing for
the use of certain grants and gifts to the Commission;
requiring the adoption and approval of certain operational
policies for certain affiliated foundations; requiring a
certain audit under certain circumstances; requiring that
copies of certain audit reports be sent to the Commission
and the Department of Fiscal Services; prohibiting certain
persons who serve on certain foundations from receiving
certain compensation; and generally relating to private
fund-raising by the Maryland Public Broadcasting Commission.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article - Education

24-207.

(A)   IT IS THE PUBLIC POLICY OF THE STATE THAT GIFTS,
DONATIONS, BEQUESTS, PRIVATE ENDOWMENTS, AND PRIVATE GRANTS MAY
BE RECEIVED BY THE COMMISSION, INCLUDING ANY INCOME THEREFROM:

(1) SHALL BE USED IN ACCORDANCE WITH THE INTENT OF
THE DONORS; AND

(2) MAY NOT BE USED AS A SUBSTITUTE FOR STATE GENERAL
FUND APPROPRIATIONS.

(B)  (1) THE COMMISSION IS ENCOURAGED TO PROMOTE PRIVATE
FUND-RAISING BY STRENGTHENING INSTITUTIONAL DEVELOPMENT
ACTIVITIES AND BY MAINTAINING RELATIONSHIPS WITH AFFILIATED
FOUNDATIONS.

(2) (I) AFFILIATED FOUNDATIONS THAT ARE INDEPENDENTLY
ESTABLISHED FOR THIS PURPOSE SHALL OPERATE SUBJECT TO POLICIES
