AN ACT concerning

Health Planning - Certificate of Need - Technical Correction

FOR the purpose of clarifying that a hospital may increase or
decrease an existing acute psychiatric medical service
during a 1-year period by 15 beds or 50 percent, whichever
is less, without obtaining a certificate of need, provided
the change does not result in a change in the total bed
capacity of the hospital.

BY repealing and reenacting, with amendments,

Chapter 688 of the Acts of the General Assembly of 1988
Section 2

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

SECTION 2. AND BE IT FURTHER ENACTED, That, notwithstanding
the provisions of § 19-115 of the Health - General Article or
applicable regulations of the Health Resources Planning
Commission, a hospital, as defined in § 19-301 of the Health -
General Article, may increase or decrease an existing acute
psychiatric medical service during a 1-year period by 15 beds or
50 percent, whichever is less, PROVIDED THE CHANGE DOES NOT
RESULT IN A CHANGE IN THE TOTAL BED CAPACITY OF THE HOSPITAL.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1989.
