Annotated Code of Maryland

(1987 Replacement Volume and 1988 Supplement)

BY repealing and reenacting, with amendments,

Article - Tax - General
Section 5-201(b) and 5-301(b)(3)
Annotated Code of Maryland
(1988 Volume)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article 2B - Alcoholic Beverages

5.

(a) The following classes of manufacturer's licenses shall

be issued at the designated annual fees:

Class 1 Distillery Annual fee $1,500

Class 2 Rectifying Annual fee $ 500

Class 3 Winery Annual fee $ 500

Class 4 Limited Winery Annual fee $ 50

Class 5 Brewery Annual fee $1,000

Class 6 [Baltimore City]

Pub-Brewery Annual fee $ 500

Class 7 Baltimore City

Micro-Brewery Annual fee $ 500

(g) (1) A Class 6 [Baltimore City] pub-brewery license
shall be issued:

(i) By the State Comptroller; and

(ii) Only to a holder of a Class B beer, wine
and liquor (on-sale) license that is issued for use on the
premises of a restaurant located in ANNE ARUNDEL COUNTY, THE CITY
OF ANNAPOLIS, OR Baltimore City.

(2)  A holder of a Class 6 [Baltimore City]
pub-brewery license:

(i) May brew malt beverages at a single
location for consumption on the restaurant premises; and

(ii) Is limited to the brewing of 2,000 barrels
of malt beverage each calendar year.

(3)  The pub-brewery premises shall be located
immediately adjacent to the restaurant where the brewed beverage
is to be sold to the public.
