wine and liquor license, which shall be paid to the [clerk for
the use of the county] BOARD OF LICENSE COMMISSIONERS before any
such license is issued.

45.

(d) (1) The board [shall in its discretion direct the clerk
not to] MAY REFUSE TO issue a license whenever in its opinion any
petitioner or petitioners is or are an unfit person or persons to
be granted such license; or in the discretion of the board when
the place for which the license is applied for is not a proper
one with reference to the public peace and general welfare of the
neighborhood or to the character of its inhabitants, due regards
being given to the number of said licenses issued for said
neighborhood as well as all specific restrictions and conditions
set forth in this article.

60.

(c) In Allegany County (1) [The clerk] (I) THE BOARD OF
LICENSE COMMISSIONERS SHALL ACCEPT AND PROCESS APPLICATIONS AND
FEES FOR ALCOHOLIC BEVERAGES LICENSES AND shall cause notice of
each application to be published once in each week for two
consecutive weeks in at least one newspaper published in the town
or city in which, or nearest to which, the applicant's proposed
place of business is to be located. (II) The notice shall
specify the residence of the applicant, the location of the place
of business and the owner of the premises for which said
application is made. (III) Where the publication might be made
in one of several newspapers the applicant may designate the one
in which the publication shall be made[; the]. (IV) THE first
publication shall be not less than fifteen days before the time
fixed for the consideration of such application.

(2)  At the time fixed by the notice for hearing upon
the application or upon any postponement of such time, any person
shall be heard on either side of the question.

(3)  In all hearings upon____applications____and

remonstrances under the provisions of this article, the general
reputation of the applicant or licensee and of the place of
business and of the people who congregate therein or thereat
shall be admissible in evidence.

63.

[(b) In Allegany County upon receipt by the Clerk of the
Court of such license fees, he shall retain the Clerk's
commission and pay the remaining fees to the county treasurer,
who shall thereupon remit and pay unto each and every
incorporated town or city in said county one half of the amount
of license fees received from the Clerk for each and every
license hereunder which shall have been issued for a place of
