A NOTARY MAY BE LIABLE TO ANY PERSON FOR ALL DAMAGES
PROXIMATELY CAUSED THAT PERSON BY THE NOTARY'S OFFICIAL
MISCONDUCT IN PERFORMING A NOTARIZATION. IN ADDITION, AN
EMPLOYER IS LIABLE TO A NOTARY FOR DAMAGES CAUSED THE NOTARY BY
DEMOTION, DISMISSAL, OR OTHER ACTION RESULTING FROM THE NOTARY'S
REFUSAL TO COMMIT MISCONDUCT.
SECTION 2. AND BE IT FURTHER ENACTED, That for a commission
expiring July 1, 1990, the Secretary of State shall, upon
application, issue a notary public commission for a term ending
on the second, third, fourth, or fifth birthday of the notary,
following the issuance of the commission., to implement a
staggered system for the expiration and renewal of notary public
commissions, may issue a notary public commission that expires in
5 years or less and, for these notary public commissions, shall
impose a fee that is prorated to reflect the term of the
commission. It shall be within the discretion of the Secretary
of State which commission term a notary is issued in accordance
with this section.
SECTION 3. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1989.
