(4) FOR A PESTICIDE NOT SUBJECT TO FEDERAL

REGISTRATION, ANY INFORMATION THE SECRETARY REQUIRES FOR THE
PRODUCT TO COMPLY WITH THIS SUBTITLE.

[(d) In addition to any other requirements of this section,
any pesticide subject to this section which contains any
substance in any quantity determined highly toxic to humans
pursuant to the provisions of § 5-104, shall bear a label showing
the following information:

(1)  The skull and crossbones;

(2)  The word "poison" prominently in red on a
background of distinctly contrasting color; and

(3)  A statement of an antidote for the product.

(e) Any pesticide, commonly known as standard lead
arsenate, basic lead arsenate, calcium arsenate, magnesium
arsenate, zinc arsenate, zinc arsenite, sodium fluoride, sodium
fluosilicate, and barium fluosilicate shall be distinctly colored
or discolored, as provided by the rules and regulations issued
under this subtitle. Any other white powder shall be distinctly
colored or discolored pursuant to departmental rules and
regulations, if the Secretary requires this action after
investigation and public hearing on the feasibility of coloration
or discoloration and on the necessity for this action for the
protection of the public health. However, the Secretary may
exempt any pesticide, to the extent that it is intended for a
particular use, from the coloring or discoloring requirements of
this section, if he determines that coloring or discoloring for
the use is not necessary for the protection of the public
health.]

The Secretary, by written order, may remove from sale any
pesticide which is adulterated, misbranded, or bears designation
identifying it with a similarly identified product which is known
to be adulterated or misbranded, or has been found to contaminate
the environment by federal or State authorities. A person may not
dispose of removed material in any manner without written consent
of the Secretary, or the circuit court of the county in which the
product is found.]

(A) THE SECRETARY MAY ISSUE AND ENFORCE A WRITTEN STOP-SALE
ORDER TO THE REGISTRANT, OWNER, CUSTODIAN, OR DISTRIBUTOR OF ANY
PESTICIDE THAT THE SECRETARY FINDS IS IN VIOLATION OF ANY
PROVISION OF THIS SUBTITLE OR REGULATION UNDER THE SUBTITLE, OR
HAS BEEN FOUND BY FEDERAL OR STATE AUTHORITIES TO CAUSE
UNREASONABLE ADVERSE EFFECTS TO HUMANS, ANIMALS, OR THE
