WILLIAM DONALD SCHAEFER, Governor Ch. 369

[(r)] (T) (S) "Official sample" means any sample of
fertilizer or soil conditioner taken and designated as "official"
by the Secretary.

[(s)] (U) (T) "Percent" or "percentage" means percentage by
weight.

(V) (U) "REGISTRANT" MEANS ANY PERSON WHO REGISTERS A
COMMERCIAL FERTILIZER OR SOIL CONDITIONER PURSUANT TO THE
PROVISIONS OF THIS SUBTITLE.

[(t)] (W) (V) "Specialty fertilizer" means a commercial
fertilizer distributed primarily for nonfarm use, such as home
gardens, lawns, shrubbery, flowers, golf courses, municipal
parks, cemeteries, greenhouses, and nurseries, and may include
commercial fertilizers used for any research or experimental
purpose.

[(u)] (X) (W) "Soil conditioner" means any substance or
mixture of substances intended (1) for sale, offered for sale, or
sold for: (1) manurial, soil enriching, or soil corrective
purposes; (2) to be used for promoting or stimulating the growth
of plants; (3) increasing the productivity of plants; (4)
improving the quality of crops; or (5) producing any chemical or
physical change in the soil, except a commercial fertilizer,
unmanipulated animal and vegetable manures, agricultural liming
material, and gypsum. It includes but is not limited to materials
such as peat, chemical penetrants, and mulch type products
VERMICULITE, OR PERLITE, THAT ARE INCORPORATED INTO THE SOIL.

[(v)] (Y) (X) "Ton" means a net weight of two thousand
pounds avoirdupois.

(a)  The Secretary shall sample, inspect, test, and make
analyses of any commercial fertilizer and soil conditioner
distributed in the State at any time and place and to an extent
the Secretary considers necessary to assure compliance with the
provisions of this subtitle.

(b)  The Secretary shall adopt the methods of sampling and
analysis from sources, such as the journal of the Association of
Official Analytical Chemists, or methods that insure
representative sampling and accurate examination.

(c)  In determining for administrative purposes whether a
commercial fertilizer or soil conditioner is deficient in any
component, the Secretary shall be guided solely by the official
sample obtained and analyzed as provided by this subtitle.

(d)   [When inspection and analysis of an official sample
indicates a commercial fertilizer or soil conditioner is found
