Ch. 360

LAWS OF MARYLAND

(1)  on the husband's credit;

(2)  as the husband's agent; or

(3)  for necessaries for herself, for his children, or
for their children.

(b)   If a husband believes that his wife is abusing the
pledging of his credit for necessaries, he may petition the
equity court for the county in which he resides for an
appropriate order.

(c)  (1) If an action is brought against a wife under
subsection (b) of this section, the wife may have counsel to
represent her.

(2) The court shall assess appropriate counsel fees
against the husband.

(d)  The court shall pass an appropriate order if the court
finds that:

(1)   the wife is abusing the pledging of the husband's
credit; and

(2)  considering the wife's station in life and the
husband's means, the husband is supplying his wife with:

(i) all necessaries to which she is entitled;
or

(ii) funds reasonably sufficient to buy
necessaries.

(e)   If the husband stops supplying his wife with
necessaries to which she is entitled, or with funds reasonably
sufficient to buy the necessaries, the wife may apply to the
court at any time to rescind the order.

(f)  A person who, after receiving from the husband written
notice of an order passed under subsection (d) of this section,
does any work for or on the order of the wife, or provides any
goods to or on the order of the wife:

(1)  may not recover from the husband for the work or
the goods; and

(2)   is liable for damages in an action by the husband
for the annoyance and mortification caused by the person's
efforts to collect from the husband for the work or the goods.]
