AN ACT concerning

Criminal Background Investigations - Child Care

FOR the purpose of requiring criminal background investigations
for certain family day care homes, certain adult residents
of a family day care home, certain individuals seeking to
adopt a child, certain adult relatives with whom a child is
placed by a local department of social services and certain
other adults; providing for a certain application process
for criminal background investigations; establishing certain
immunity; and generally relating to criminal background
investigations.

BY repealing and reenacting, with amendments,

Section 5-561, 5-562, 5-563, 5-564(c) and (d), and 5-567(a)
to be under the amended part "Part VI. Criminal
Background Investigations for Employees of
Facilities and Other Individuals That Care for or
Supervise Children"

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY' OF
MARYLAND, That the Laws of Maryland read as follows:

Article - Family Law

Part VI. Criminal Background Investigations for Employees'
of Facilities AND OTHER INDIVIDUALS That Care
for or Supervise Children
5-561.

(a)  Notwithstanding any provision of law to the contrary,
an employee and employer in a facility identified in subsection
(b) of this section AND PERSONS IDENTIFIED IN SUBSECTION (C) OF
THIS SECTION shall apply for a federal and State criminal
background investigation at any designated law enforcement office
in this State.

(b)  The following facilities shall require employees and
employers to obtain a criminal background investigation under
this Part VI:

(1) a child care center required to be licensed
under Part VII of this subtitle;
