Ch. 306                                           LAWS OF MARYLAND

WATERS OF THE STATE IS GREATER THAN AN AVERAGE ANNUAL WATER USE
OF 10,000 GALLONS PER DAY BUT LESS THAN AN AVERAGE ANNUAL WATER
USE OF 50,000 GALLONS PER DAY.

8-808.1.

(A) THE DEPARTMENT MAY ADOPT RULES AND REGULATIONS

NECESSARY TO CARRY OUT THE PURPOSE AND INTENT OF THIS SUBTITLE.

(B) IN PREPARING REGULATIONS UNDER THIS SUBTITLE, THE
DEPARTMENT SHALL ADDRESS AS APPROPRIATE THE POTENTIAL IMPACTS,

INCLUDING ENVIRONMENTAL IMPACTS, OF PERMITTED ACTIVITIES

ASSOCIATED WITH THE PHYSICAL REMOVAL APPROPRIATION OR USE OF
WATER PURSUANT TO WATER APPROPRIATION PERMIT REGULATIONS ON THE
QUALITY OF GROUNDWATERS AND SURFACE WATERS.

8-814.

[Any] A person who violates or causes an act which violates
[the provisions] A PROVISION of this subtitle or A REGULATION
ADOPTED UNDER THIS SUBTITLE OR WHO violates or fails to comply
with [any] A PERMIT OR AN order of the Department when due notice
is given is guilty of a misdemeanor. Upon conviction [he] THE
VIOLATOR is subject to a fine not exceeding [$1,000] $500 PER DAY
FOR EACH DAY OF THE OFFENSE, AND NOT TO EXCEED A TOTAL FINE OF
$25,000, with costs imposed in the discretion of the court.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1989.

AN ACT concerning

Division of Correction - Lie Detector Test

FOR the purpose of altering a definition so as to provide that

certain employees of the Division of Correction may be

required to take a lie detector test as a condition of
employment.
