WILLIAM DONALD SCHAEFER, Governor

Ch. 3

REVISOR'S NOTE: Subsection (a)(1) of this section is new
language added to state expressly that the Board must
give notice to qualified applicants. This addition
conforms to the practice of the Board.

Subsection (a)(2) of this section is new language
derived without substantive change from former Art.
56, § 481, as that section related to submission of
health certificates and deposit of registration fees,
and items (a) and (b) of the second sentence of § 500,
as those items related to registration fees. Although
former Art. 56, § 481 required that the certificate
and fee accompany an application, it has been the
practice of the Board to require submission of a
certificate and payment of a license fee only after an
applicant has met all of the other requirements for
licensure.

Subsection (b) of this section is new language derived
without substantive change from the first sentence of
former Art. 56, § 493, as that sentence related to
issuing certificates of registration to those who pass
the required examinations and pay the required fees,
and rephrased in standard language, which covers
applicants who waive the examination requirement.

Subsection (c) of this section is new language derived
without substantive change from the second clause of
former Art. 56, § 495(d).

In subsection (a)(2)(i) of this section, the reference
to a certificate that "certifies that the applicant is
free from any infectious or contagious disease that
presents a hazard to a beauty salon patron" is
substituted for the former reference to a "health"
certificate, for clarity.

Also in     subsection (a)(2)(i) of this section, the

reference   to an "authorized" physician is substituted

for the     former reference to a "registered licensed

physician  of Maryland", for clarity and brevity.

In subsections (a)(2)(ii) and (b) of this section, the
term "license fee" is substituted for the former term
"registration fee", for clarity and uniformity. The
fee paid by an individual who qualifies for a license
is described throughout this article as a license fee.

Defined terms: "Beauty salon" § 5-101
"Board" § 5-101 "Cosmetologist" § 5-101
"License" § 5-101 "Limited license" § 5-101
"Practice cosmetology" § 5-101
