"on the first Tuesday of each month, whenever
possible", which was impractical.
Also in subsection (b) of this section, the word
"executive", which formerly modified the word
"meeting", is deleted as surplusage.
The introductory phrase of subsection (c) of. this
section, "[s]ubject to the State budget", is added to
indicate that the State budget controls funding for
members of the Board.
In subsection (c)(2) of this section, the words
"necessary" and "traveling", which formerly modified
the word "expenses", and the former phrases "for
attendance at Board meetings" are deleted as
unnecessary in light of the reference to the Standard
State Travel Regulations. See COMAR 23.02.01.01
through 12.
Former Art. 56, § 491 and the second sentence of §
490, which provided in detail for the staff position
of secretary to the Board, are deleted as obsolete.
All staff to the Board is provided through the
Department and compensated in accordance with the
State budget.
The second sentence of former Art. 56, § 492, which
required 1 member of the Board to be available for
consultation at all times, is deleted as obsolete and
impractical.
The third sentence of former Art. 56, § 492, which
provided for payment of compensation and expenses
"upon the approval of the chairman of said Board", is
deleted as inaccurate in light of current budgetary
policies. Furthermore, the Department provides
clerical and other "office help", so that the Board
does not incur these expenses directly. Similarly,
with respect to "professional advice", the Secretary
has the authority to employ professional consultants,
and the Attorney General provides legal advice. See
Art. 41, § 8-103(b) and (d) of the Code.
