BY repealing and reenacting, with amendments,

Article - Agriculture

Section 6-107(d) and (e) and 6-113

Annotated Code of Maryland

(1985 Replacement Volume and 1988 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article - Agriculture

6-107.

(a)   [A person] EXCEPT AS PROVIDED IN SUBSECTION (E) OF THIS
SECTION, A DISTRIBUTOR shall register each BRAND NAME OR PRODUCT
NAME OF commercial feed before distributing it in the State.
Customer-formula feeds and contract feeds are exempt from
registration if the registration fee is paid on the commercial
feeds which they contain.

(b)   [A person shall register only those customer-formula
feed manufacturing facilities which produce a guaranteed analysis
feed and if a person has two or more portable customer-formula
feed mixers, he shall register those which produce a guaranteed
analysis feed.

(c)] The registration application for commercial feeds
shall be submitted on forms furnished by the Secretary, and shall
also be accompanied by a label or other printed matter describing
the product if requested by the Secretary. The application shall
include the information required by §§ 6-109, 6-110, and 6-111.
[The registration application for customer-formula feed
manufacturing facilities and portable customer-formula feed
mixers, both of which produce a guaranteed analysis feed, shall
be submitted on forms furnished by the Secretary, and shall
include the applicant's name, place of business, location of each
facility, and such other information as the Secretary may
prescribe.] When the Secretary has approved the registration, he
shall furnish a copy to the applicant.

(d) (C) The annual registration fee for each commercial
feed distributed in the State is [$30] $35. Customer-formula
feeds and contract feeds are exempt if the registration fee is
paid on the commercial feeds which they contain. The annual
registration fee for each nonportable customer formula feed
manufacturing facility which produces a guaranteed analysis feed
in the State is $100. [The annual registration fee for portable
customer-formula feed mixers used in the State is $20 for each
mixer which produces a guaranteed analysis feed. However, for any
person owning five or more such mixers, the annual registration
fee is $100. For any person registering a nonportable
