LAWS OF MARYLAND

The provision of the first sentence of former Art. 56,
§ 503 that excluded "service in case of emergency
without compensation" is deleted as unnecessary since
the definition of "practice cosmetology" limits the
scope of this title to individuals engaged in
commercial activities.

The second sentence of former Art. 56, § 503, which
excluded "railroad companies" and "sleeping or parlor
car companies", is deleted as obsolete.

SUBTITLE 2. STATE BOARD OF COSMETOLOGISTS.

5-201. ESTABLISHED.

THERE IS A STATE BOARD OF COSMETOLOGISTS IN THE DEPARTMENT.

REVISOR'S NOTE: This section formerly appeared as the first
sentence of Art. 56, § 489.

It is set forth as a separate section for emphasis.

The only changes are in style.

Defined terms: "Cosmetologist" § 5-101
"Department" § 1-101

5-202. MEMBERSHIP.

(A)  COMPOSITION; APPOINTMENT OF MEMBERS.

(1)  THE BOARD CONSISTS OF 5 MEMBERS.

(2)  OF THE 5 MEMBERS OF THE BOARD:

(I)  3 SHALL BE LICENSED COSMETOLOGISTS; AND

(II)  2 SHALL BE CONSUMER MEMBERS.

(3)  THE GOVERNOR SHALL APPOINT THE MEMBERS WITH THE
ADVICE OF THE SECRETARY.

(B)  QUALIFICATIONS OF COSMETOLOGIST MEMBERS.
EACH COSMETOLOGIST MEMBER OF THE BOARD:

(1)  SHALL HAVE PRACTICED COSMETOLOGY ACTIVELY FOR AT
LEAST 5 YEARS BEFORE APPOINTMENT;

(2)  SHALL BE A CITIZEN OF THE STATE;

(3)  MAY NOT BE AFFILIATED DIRECTLY OR INDIRECTLY WITH
ANY SCHOOL OF COSMETOLOGY;
