LAWS OF MARYLAND
SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:
Article - Agriculture
6-301.
(a) In this subtitle the following words have the meanings
indicated.
(b) "Agricultural liming materials" means any substance
that contains calcium and magnesium in condition and quantity
suitable for use in neutralizing soil acidity, or that is used as
an ingredient or reagent in the preparation of any fungicide or
insecticide.
(C) "DISTRIBUTE" MEANS TO IMPORT, MANUFACTURE, PRODUCE,
MIX, EXCHANGE, SELL, OFFER FOR SALE, CONSIGN, FURNISH, PROVIDE,
OR SUPPLY AN AGRICULTURAL LIMING MATERIAL OR GYPSUM AS PART OF A
COMMERCIAL ENTERPRISE.
(C) "DISTRIBUTOR" MEANS A PERSON WHO IMPORTS, MANUFACTURES,
PRODUCES, MIXES, EXCHANGES, SELLS, OFFERS FOR SALE, CONSIGNS,
FURNISHES, PROVIDES, OR SUPPLIES AGRICULTURAL LIMING MATERIAL OR
GYPSUM AS PART OF A COMMERCIAL ENTERPRISE.
[(c)] (D) "Gypsum" means any product that consists chiefly
of calcium sulfate and is intended for use for agricultural
purposes.
(E) "REGISTRANT" MEANS ANY PERSON WHO REGISTERS ANY
AGRICULTURAL LIMING MATERIAL OR GYPSUM PURSUANT TO THE PROVISIONS
OF THIS SUBTITLE.
6-305.
(a) Every manufacturer or importer of EACH BRAND OR TRADE
NAME OF agricultural liming materials or gypsum, or both, who
[offers for sale] DISTRIBUTES agricultural liming materials or
gypsum [first] shall [file] REGISTER with the Secretary , by
[January] FEBRUARY 1 of each year[, a statement of any material
he shall offer for sale during the next year]. The [filing
statement] APPLICATION FOR REGISTRATION shall be accompanied by a
copy of the statement of the composition of the brands of the
materials required by § 6-307.
(b) Each [distributor] APPLICANT FOR REGISTRATION shall pay
an annual [$100] $110 registration fee for agricultural liming
materials and gypsum sold or distributed in the State. In
addition, each [distributor] REGISTRANT shall pay an inspection
fee at the rate of [5] 10 cents per ton sold in the State.
