AN ACT concerning
Weights and Measures - Minimum Loads on Vehicle Scales -
Exemption
FOR the purpose of exempting certain persons who use commercial
vehicle scales to measure certain minimum loads from certain
specifications, tolerances, and technical requirements for
commercial weighing and measuring devices; and providing for
the application of this Act.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

11-203.
(C) (1) [The] EXCEPT AS PROVIDED IN PARAGRAPHS (2) AND (3)
PARAGRAPH (2) OF THIS SUBSECTION, THE specifications, tolerances,
and other technical requirements for commercial weighing and
measuring devices, specified in § 11-204, shall be those adopted
by the National Conference on Weights and Measures and included
in the National Bureau of Standards Handbook 44, as amended.
These specifications, tolerances, and other technical
requirements shall remain in effect unless modified or rescinded
by a rule or regulation adopted by the Secretary.
(2) PARAGRAPH (3) OF THIS SUBSECTION APPLIES ONLY TO
COMMERCIAL VEHICLE SCALES THAT ARE USED IN:
(I) THE BUSINESS OF RECYCLING, INCLUDING THE
COLLECTION, PROCESSING, STORAGE, PURCHASE, SALE, OR DISPOSITION
OF RECYCLABLE MATERIALS NEWSPAPER, CARDBOARD, ALUMINUM MATERIALS,
TIN CANS, BIMETAL CANS, AND PLASTICS; OR
(II) THE OPERATION OF A JUNKYARD OR SCRAP METAL
PROCESSING FACILITY.
(3) (2) NOTHING IN THE SPECIFICATIONS, TOLERANCES,
AND OTHER TECHNICAL REQUIREMENTS FOR COMMERCIAL WEIGHING AND
