AN ACT concerning
Creation of a State Debt - Community Mental Health Facilities,
Addiction Facilities, and Developmental Disabilities Facilities
Loan of 1989
FOR the purpose of authorizing the creation of a State Debt in
the amount of $5,000,000 $7,500,000 the proceeds to be used
for State grants for the construction, acquisition,
renovation, and equipping of community mental health
facilities, addiction facilities, and developmental
disabilities facilities (including the reports, plans,
specifications, site improvements, surveys, and programs in
connection therewith); defining certain terms; requiring
certain information from grantees; requiring the Department
of Health and Mental Hygiene to make recommendations and
adopt regulations for approving projects, including
regulations providing for continuing information; placing
certain terms, conditions, and limits on the allocation,
use, and amount of the grants; providing that the State may
recover a certain portion of the State funds expended under
certain circumstances; providing for certain judicial
proceedings and liens; to enforce providing for the
enforcement of the State's right of recovery and the
priority of the proceedings and liens permitting the Board
of Public Works to adopt certain regulations; providing that
no proceeds of a grant may be used for certain religious
purposes; and providing generally for the issuance and sale
of bonds evidencing the loan.
SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That:
(1) The Board of Public Works may borrow money and incur
indebtedness on behalf of the State of Maryland through a State
loan to be known as the Community Mental Health Facilities,
Addiction Facilities, and Developmental Disabilities Facilities
Loan of 1989 in the aggregate principal amount of $5,000,000
$7,500,000. This loan shall be evidenced by the issuance and
sale of State general obligation bonds authorized by a resolution
of the Board of Public Works and issued, sold, and delivered in
accordance with §§ 8-117 through 8-124 of the State Finance and
Procurement Article and Article 31, § 22 of the Code.
