LAWS OF MARYLAND

(2) A copy of the finding and the notice to the
facility to which the individual is being transferred shall be
sent to the guardian or next of kin of the individual.

[(d) An individual may not be transported to or from any
facility unless accompanied by:

(1)  An individual who is authorized by the facility
and is of the same sex. HOWEVER, THE CHIEF EXECUTIVE OFFICER" OF
THE FACILITY OR THAT OFFICER'S DESIGNEE MAY DESIGNATE A PERSON OF
EITHER SEX TO PROVIDE TRANSPORTATION TO AN INDIVIDUAL, IF DEEMED
APPROPRIATE; or

(2)  The parent, spouse, adult sibling, or adult
offspring of the individual.]

(D) (1) THE CHIEF EXECUTIVE OFFICER OF THE FACILITY OR THAT

OFFICER'S DESIGNEE MAY DESIGNATE A PERSON TO PROVIDE

TRANSPORTATION TO AN INDIVIDUAL.

(2) THE DESIGNATION TO A PERSON TO PROVIDE

TRANSPORTATION IS TO BE BASED ON A SPECIFIC ASSESSMENT OF ANY
NEED FOR THE SAME SEX OR OTHER SPECIAL TRANSPORTATION NEEDS OF
THE INDIVIDUAL.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1989.
