Marine Terminal may be expired
only if: (1) the total amount of

cargo tonnage moving through

administration facilities

(including Canton Seagirt) for

the twelve months ending

September 30, 1989 exceeds by at

least four percent the total

amount of cargo tonnage moved
through those facilities during

the twelve months ending

September 30, 1988, or (2)

approved by the budget

committees. If any portion of
this restriction is determined to
be invalid by any court or by
opinion of the Attorney General,
the invalidity shall not affect

such other elements of this

restriction as may be given

effect without the invalid
