SUBTITLE 2. STATE BOARD OF BARBERS.

4-201. ESTABLISHED.

THERE IS A STATE BOARD OF BARBERS IN THE DEPARTMENT.

REVISOR'S NOTE: This section is new language derived
without substantive change from the provisions of the
first sentence of former Art. 56, § 428(a) that
related to the Board.

It is set forth as a separate section for emphasis.

The word "State" is substituted for the former phrase
"for the State of Maryland", to avoid use of the
duplicative terms "Maryland" and "State" and to
correspond with other board designations used in this
article.

The former word "Examiners" is deleted from the title
of the Board. In practice, the Board performs
functions that go beyond merely "examining" applicants
for licenses and, therefore, retaining the former word
in the title of the Board might seem to limit its
functions.

4-202. MEMBERSHIP.

(A)  COMPOSITION; APPOINTMENT OF MEMBERS.

(1)  THE BOARD CONSISTS OF 7 MEMBERS.

(2)  OF THE 7 MEMBERS OF THE BOARD:

(I)  5 SHALL BE MASTER BARBERS; AND

(II)  2 SHALL BE CONSUMER MEMBERS.

(3)  THE GOVERNOR SHALL APPOINT THE MEMBERS WITH THE
ADVICE OF THE SECRETARY.

(B)  QUALIFICATIONS OF BARBER MEMBERS.

EACH MASTER BARBER MEMBER OF THE BOARD SHALL HAVE PRACTICED
BARBERING IN THE STATE CONTINOUSLY FOR AT LEAST 5 YEARS BEFORE
APPOINTMENT.

(C)  QUALIFICATIONS OF CONSUMER MEMBERS.
