of the said institutions, together with a statement of the number
of prisoners, their age, sex, color, place of nativity BIRTH and
conviction, offense, term of confinement, escapes, pardons, and
discharges, accompanied by such remarks and suggestions as may
appear necessary to the advancement of the interests of said
institutions.

(B) The Commissioner, at the time of making such annual
report to the Secretary and to the Governor, shall transmit
therewith a statement similar to that required to be made to the
Comptroller in § 677; and the statements and reports required to
be made in this section and § 677 of this article shall be duly
sworn to by the Commissioner of Correction[, and, subject].

(C) SUBJECT to § 2-1312 of the State Government Article,
the Governor shall communicate such statements and reports
DESCRIBED IN SUBSECTIONS (A) AND (B) OF THIS SECTION to the
General Assembly with such recommendations as he may think
expedient.

Article 31B - Patuxent Institution

1.

(a)  In this article, the following words have the meanings
indicated unless the context clearly requires otherwise.

(b)   ["Board" means the board of Patuxent Institution.

(c)] "Board of review" means the institutional board of
review, created by § 6.

[(d)] (C) "Commissioner" means the Commissioner of
Correction..

[(e)] (D) "Department" means the Department of Public
Safety and Correctional Services.

[(f)] (E) "Director" means the director of Patuxent
Institution.

[(g)] (F) (1) "Eligible person" means a person who (i) has
been convicted of a crime and is serving a sentence of
imprisonment with at least three years remaining on it, (ii) has
an intellectual deficiency or emotional unbalance, (iii) is
likely to respond favorably to the programs and services provided
at Patuxent Institution, [and] (iv) can be better rehabilitated
through those programs and services than by other incarceration,
AND (V) MEETS THE ELIGIBILITY CRITERIA ESTABLISHED BY THE
SECRETARY UNDER § 8 OF THIS ARTICLE.

(2) "Eligible person" does not include a person who
(i) is serving 2 or more sentences of imprisonment for life under
