AN ACT concerning

Patuxent Institution - Organization and Procedures
- Annual Report

FOR the purpose of altering the criteria for eligibility for
incarceration at Patuxent Institution; amending the purpose
of the Institution; eliminating the Board of Patuxent
Institution and requiring the Governor to appoint a
citizen's advisory board; requiring the Secretary of Public
Safety and Correctional Services to adopt certain
regulations pertaining to Patuxent Institution; altering the
membership, terms of office, and procedures of the Patuxent
Institution Board of Review; requiring notice to certain
victims before an inmate may be given work release, parole,
or leave from Patuxent Institution; defining certain terms;
requiring the Board of Review to give the victim a
reasonable opportunity to comment on parole; requiring the
Board of Review to delete the victim's address and phone
number before examination of any document by the eligible
person or the eligible person's representative; authorizing
the victim to designate, in writing to the Board of Review,
a representative of the victim; requiring certain inmates to
serve certain minimum terms before being eligible for parole
from Patuxent Institution; prohibiting parole from the
Institution without the approval of the Secretary of Public
Safety and Correctional Services; providing certain
penalties for committing certain violations while on work
release, leave, or parole; requiring the Director of the
Patuxent Institution to issue certain annual reports on
financial matters and certain aspects of the inmate
population of the Patuxent Institution; requiring annual
reports by the Director of the Patuxent Institution to be
sent to the Secretary of Public Safety and Correctional
Services and the Governor; making conforming and stylistic
changes; requiring the Secretary of Public Safety and
Correctional Services to conduct a study of Patuxent
Institution; requiring the Secretary of Public Safety and
Correctional Services to develop certain criteria for
measuring recidivism rates for Patuxent Institution and the
Division of Correction; requiring the Secretary of Public
Safety and Correctional Services to review the status of
work release and leave inmates at Patuxent Institution
before reinstituting the work release and leave programs;
making provisions of this Act severable; making this Act an
emergency measure; and generally relating to the
organization and procedures of Patuxent Institution.
