WILLIAM DONALD SCHAEFER, Governor                        Ch. 6

(1)  GOVERNING CRITERIA TO DETERMINE ELIGIBILITY FOR
REFERRAL OF AN INMATE TO THE INSTITUTION; AND

(2)   GOVERNING LEAVE, WORK RELEASE, AND PAROLE FROM
THE INSTITUTION; AND

(3) ESTABLISHING WITH SPECIFICITY MAJOR VIOLATIONS OF
THE INSTITUTION'S DISCIPLINARY RULES.

6.

(a)  There is a board of review for the Institution. It
consists of:

(1)  The director;

(2)  The three associate directors; AND

(3)   [The professor of the University of Maryland
School of Law, the professor of the University of Baltimore
School of Law, and one of the two members of the Maryland Bar who
are members of the board; and

(4)  A sociologist appointed by the board from the
faculty of an accredited institution of higher education in
Maryland.] FIVE MEMBERS OF THE GENERAL PUBLIC APPOINTED BY THE
GOVERNOR WITH THE ADVICE AND CONSENT OF THE SENATE, ONE OF WHOM
IS A MEMBER OF A VICTIM'S RIGHTS ORGANIZATION.

(b)   [In the absence of the director or an associate
director, the board shall appoint a substitute member of the
board of review from among the professional staff of the
Institution, to serve during the period of the director's or
associate director's absence.] THE GOVERNOR SHALL DESIGNATE THE
CHAIRMAN OF THE BOARD OF REVIEW.

(c)  (1) [Five] SIX SEVEN members of the board of review,
including at least [one who is also a member of the board,] 3 WHO
ARE MEMBERS OF THE GENERAL PUBLIC, constitutes a quorum.

(2) ALL ACTIONS BY THE BOARD OF REVIEW REQUIRE THE
APPROVAL OF A MAJORITY OF THE MEMBERS EXCEPT THAT A DECISION TO
GRANT PAROLE, WORK RELEASE, OR LEAVE TO AN ELIGIBLE PERSON
REQUIRES THE APPROVAL OF 7 MEMBERS.

(d)  Employees of the Institution who are members of the
board of review or who attend its meetings or work as advisors to
the board of review shall serve in that capacity as part of their
regular duties without additional compensation. The other members
of the board of review shall receive [per diem] compensation [for
each day spent in the duties of the board of review] as provided
in the State budget.
