the requirement that overtime be paid as provided in this section
shall be consistent with the provisions of Division II of the
State Finance and Procurement Article, and shall be:

(2) Made a part of the contract covering the project,
which contract is deemed to be a contract of the character
specified in § 103 of the federal Contract Work Hours AND SAFETY
Standards Act.

(d) Except as provided in subsection (e) of this section,
of the proceeds collected annually from the additional fees

(1) The first $150,000 shall be paid into a special
fund administered by the Maryland Higher Education Commission for
use in the medical, dental, legal, nursing, and pharmaceutical
scholarship programs provided by this State; [and]
