expiration of the grace period does not bar renewal of
the license. For clarity, however, this section
provides that, after the grace period, a license can
no longer be renewed but can be reinstated.

Item (3) of this section is new language derived
without substantive change from the first clause of
former Art. 56, § 466(h) and item 4 of the second
sentence of § 472(a).

3-311. DENIALS, REPRIMANDS, SUSPENSIONS, AND REVOCATIONS --
GROUNDS.

SUBJECT TO THE HEARING PROVISIONS OF § 3-313 OF THIS
SUBTITLE, THE BOARD, ON THE AFFIRMATIVE VOTE OF 4 OF ITS MEMBERS,
MAY DENY A LICENSE TO ANY APPLICANT, REPRIMAND ANY LICENSEE, OR
SUSPEND OR REVOKE A LICENSE IF:

(1)  THE APPLICANT OR LICENSEE FRAUDULENTLY OR
DECEPTIVELY OBTAINS OR RENEWS OR ATTEMPTS TO OBTAIN OR RENEW A
LICENSE OR PERMIT FOR THE APPLICANT OR LICENSEE OR FOR ANOTHER;

(2)  THE APPLICANT OR LICENSEE FRAUDULENTLY OR
DECEPTIVELY USES A LICENSE;

(3)  THE APPLICANT OR LICENSEE PLEADS GUILTY OR NOLO
CONTENDERE WITH RESPECT TO, RECEIVES PROBATION BEFORE JUDGMENT
WITH RESPECT TO, OR IS CONVICTED OF:

(I)  A CRIME INVOLVING MORAL TURPITUDE; OR

(II)  A VIOLATION OF ANY ELECTION LAW OF THE
STATE;

(4)  DURING THE COURSE OF AN OFFICIAL INVESTIGATION BY
AN AUTHORIZED PUBLIC OFFICIAL OR PUBLIC BODY AND REGARDLESS OF
WHETHER THE MATTER IS PROSECUTED, THE APPLICANT OR LICENSEE HAS
ADMITTED, IN WRITING OR UNDER OATH, TO:

(I)  A CRIME INVOLVING MORAL TURPITUDE; OR

(II)  A VIOLATION OF ANY ELECTION LAW OF THE
STATE;

(5)  THE APPLICANT OR LICENSEE IS GUILTY OF ANY FRAUD,
GROSS NEGLIGENCE, INCOMPETENCE, OR MISCONDUCT WHILE PRACTICING
ARCHITECTURE;

(6)  THE APPLICANT OR LICENSEE KNOWINGLY VIOLATES ANY
PROVISION OF THE CODE OF ETHICS ADOPTED BY THE BOARD;
