(a) In addition to the compensation provided for herein the
employer shall promptly provide for an injured employee, for such
period as the nature of the injury may require, such medical,
surgical or other attendance or treatment, nurse and hospital
services, medicines, crutches, apparatus, artificial hands, arms,
feet and legs and other prosthetic appliances as may be required
by the Commission, provided, however, that any order or award of
the Commission, under this subsection, shall not be construed to
reopen any case, or permit any previous award to be changed or
modified, except as provided in [§ 40(c) and 40(d)] § 40(C) AND
(D) of this article.

(c) Where the employer has been given notice, or the
employer, or his designated representative in the place where the
injury occurred, has knowledge of any injury or death of an
employee, and the employer fails, neglects or refuses to file a
report thereof, as required by the provisions of subsection (b)
of this section, the limitations prescribed by this article shall
not begin to run against the claimant or any person entitled to
compensation until such report shall have been furnished as
required by subsection (b) of this section. This section shall
not apply to an "employee" as defined by [§ 67(3)] § 67(4) of
this article.

In every case providing for compensation to the injured
employee or his dependent, excepting temporary disability, the
Commission may, if in its opinion the facts and circumstances of
