(e) The Commission may make and adopt and, from time to
time, amend a plan which shall identify and designate sites,
structures with their appurtenances and environmental settings,
or districts having a historical, archeological, architectural or
cultural value, provided that the criteria for the designation or
identification is not inconsistent with the criteria applicable
to the Maryland Historical Trust under Article 41B, [§ 5-605(f)]
§ 5-605 of the Annotated Code of Maryland. In making or amending
of the plan, the Commission may establish advisory committees to
assist it in the performance of its duties. The plan shall
constitute an amendment to the general plan for the
Maryland-Washington Regional District except that the plan may
include sites, structures with their appurtenances and
environmental settings, or districts located in municipalities
within Montgomery and Prince George's counties, not subject to
the jurisdiction of the Commission, with the consent of the
governing body of that municipality. Consent of the governing
body shall constitute the agreement of the municipality to be
bound by all rules and regulations governing such sites,
structures with their appurtenances and environmental settings,
or districts as may be enacted by the district council.

into under this subsection does not affect the WSSC's power with
respect to public and semipublic water supply and sanitary
sewerage systems specified in this section and § 8-102 of this
[subtitle] TITLE.
