(3)  In the event that the licensee has volunteered
for or been called into the armed forces of the United States or
the regular [State Militia,] STATE MILITIA; or

(4)  In the event that a license holder of one class
surrenders his license and obtains a license of another class
carrying a higher fee, in which case the refund shall be deducted
from the amount of the fee to be paid for the newly obtained
[license,] LICENSE; or

(5)  In the event that a licensee, against whom
charges are pending at the time he renews his annual license, is
found guilty of such charges and his license is revoked, or upon
appeal the board's decision is reversed and renewal of license is
refused after he has paid his fee for the renewal thereof, in
which case he shall be entitled to a refund of the unearned
portion of his annual fee from the date the revocation becomes
[final.] FINAL; OR

(6)  In the event that the licensed premises are taken
by the federal government, the State or any city or municipality
for public use.

Error: Omitted conjunction and punctuation errors in
Article 2B, § 64(a).

Occurred: Ch. 417, Acts of 1959 added subsection
(a)(6) without correcting punctuation of subsection
(a)(5); other punctuation errors occurred prior to
1957 codification of the Annotated Code of Maryland.

69.

(d-1) In Garrett County, in addition to any other
provisions of this article, the license of any person may be
suspended for a period of time to be determined by the board not
to exceed 1 year, for any of the following grounds: (1) sale of
alcoholic beverages to a person under 21 years of age, [and in
the case of beer and light wine, to a person not designated under
§ 2(t)(2) of this article,] (2) possession on the licensed
premises by any person of any liquor or wines not purchased from
the Garrett County liquor dispensaries, if the Garrett County
liquor control board maintains county liquor dispensaries, (3)
sale of alcoholic beverages on Sunday. The decision of the board
in these cases is conclusive.
