[(2) In the case of beer and light wine, "consumer"
includes any natural person over the age of 21 years, and any
natural person under 21 years of age who was born before July 1,
1964, and any corporation not otherwise interdicted by this
article or any other law of this State, who buys, possesses,
keeps or transports beer or light wine upon which the taxes
provided by the tax provisions of this article have been paid,
for his own use and not for sale.]

Error: Obsolete definition in Article 2B, § 2(t)(2).

Occurred: Became obsolete in 1985 when all persons in
the designated category reached the age of 21 years.

(u) (2) Any alcoholic beverages found in any container
without a regular label truly describing the contents and stating
the true name of the importer, manufacturer, bottler or rectifier
shall be presumed to be an illicit alcoholic beverage, provided
further that such presumption shall not apply to any alcoholic
beverages found:

(i) In drinking glasses or other similar open
containers for drinking [purposes or,] PURPOSES; OR

(ii) In home-type decanters found in a dwelling
house or in a punch bowl or other receptacle of a similar nature,
if found under circumstances which indicate that the alcoholic
beverages contained therein are intended for consumption on the
[premise] PREMISES by consumers and not for [sale or,] SALE; OR

(iii) In containers possessed by a proper
retail alcoholic beverage licensee when such alcoholic beverages
are premixed for lawful sale and consumption.

transported, kept or suffered to be bought, possessed, stored,
imported, transported or kept in any vehicle, vessel or aircraft
