REVISOR'S NOTE: Subsection (a)(1) and (2) of this section
is new language added to conform to almost all of the
occupational licensing acts adopted by the General
Assembly in the past several years. See, e.g., the
comparable sections on disciplinary actions in the
various titles of the Health Occupations Article. The
General Assembly expressly decided that the language
of these items was to be included in each of those
sections as a fundamental ground for disciplining a
licensee.

Subsections (a)(3) and (4), (b), and (c) of this
section are new language derived without substantive
change from former Art. 56, § 67, the first sentence
and the second clause of the sixth sentence of §
70(a), and from the second clause of the third
sentence of former Art. 81, § 446.

Subsections (a)(3) and (4) and (c) are revised to
apply to any license.

In this section, the phrase "subject to the hearing
provisions of § 619 of this subtitle" is added for
clarity.

In the introductory language of subsections (a) and
(c) of this section, the reference to the power to
"deny a license to any applicant" is standard language
added to state expressly a power that formerly only
was implied in the law -- that the Comptroller may
deny a license to an applicant who violates a
disciplinary provision under this section.

In the introductory language of subsection (a) of this
section, the reference to the Comptroller's power to
reprimand a licensee is added to state specifically a
power that is inherent in the express power to suspend
or revoke a license.

Also in the introductory language of subsection (a) of
this section, the reference to a "finding" by the
Comptroller is deleted as surplusage.

In subsection (a)(3) of this section, the former word
"rules" is deleted as surplusage.

In subsection (a)(4) of this section, the former
reference to resale "at wholesale, as defined in §
11-501(1) of the Commercial Law Article of the Code,
or at retail, as defined in § ll-501(i) of the
Commercial Law Article of the Code" is deleted as
surplusage.

In subsection (c) of this section, the condition that
an applicant comply with "the requirements of this
