VETOES

In accordance with Article II, Section 17 of the Maryland
Constitution, I have today vetoed Senate Bill 704.

This bill provides for municipal governments to receive a payment
of income tax revenues.

House Bill 1208, which was passed by the General Assembly and
signed by me on May 17, 1988, accomplishes the same purpose.
Therefore, it is not necessary for me to sign Senate Bill 704.

AN ACT concerning

State Income Tax - Distribution to Municipalities

FOR the purpose of providing a certain payment of income tax
revenues to certain municipal governments; and generally
relating to the Maryland income tax.

BY repealing and reenacting, with amendments,

Article 81 - Revenue and Taxes

Section 283(c)(2)

Annotated Code of Maryland

(1980 Replacement Volume and 1987 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article 81 - Revenue and Taxes

283.

(c) (2) (i) After deducting the cost of any refunds and the
prorated share of the cost of operating the Income Tax Division,
the Comptroller shall pay over the balance to the appropriate
local fiscal authority. All such payments shall be made by the
Comptroller as soon as practicable.

(ii) For fiscal year 1988 only, due to the
uncertainties of the revenue effect of the various provisions of
the Tax Reform Act of 1986, in addition to the amounts provided
for in subparagraph (i) of this paragraph, the Comptroller shall
