WILLIAM DONALD SCHAEFER, Governor

(B)(1) EXCEPT FOR A GOVERNMENTAL AGENCY OR INSTRUMENTALITY

AND AN EMPLOYER THAT ISSUES IDENTIFICATION CARDS TO ITS

EMPLOYEES, A PERSON MAY NOT SELL, ISSUE, OR OFFER FOR SALE OR
OFFER FOR ISSUE ANY IDENTIFICATION CARD OR DOCUMENT PURPORTING TO
CONTAIN THE AGE OR DATE OF BIRTH OF A PERSON.

(B) (1) (I) EXCEPT AS PROVIDED IN SUBPARAGRAPH (II) OF THIS
PARAGRAPH, A PERSON MAY NOT SELL, ISSUE, OFFER FOR SALE, OR OFFER
TO ISSUE ANY IDENTIFICATION CARD OR DOCUMENT WHICH CONTAINS A
BLANK SPACE FOR A PERSON'S AGE OR DATE OF BIRTH, OR INCORRECT AGE
OR DATE OF BIRTH OF A PERSON.
                                                                 

(II) A MANUFACTURER OF IDENTIFICATION CARDS OR
DOCUMENTS MAY SELL OR ISSUE IDENTIFICATION CARDS OR DOCUMENTS
CONTAINING A BLANK SPACE FOR A PERSON'S AGE OR DATE OF BIRTH TO
EMPLOYERS, FOR USE AS EMPLOYEE IDENTIFICATION CARDS OR DOCUMENTS,
OR TO HOSPITALS, FOR USE AS PATIENT IDENTIFICATION CARDS, OR TO
GOVERNMENTAL AGENCIES:

(2)  THE STATE'S ATTORNEY FOR ANY COUNTY OR THE CITY
OF BALTIMORE IN WHICH A VIOLATION OF THIS SECTION OCCURS OR THE
ATTORNEY GENERAL MAY PETITION TO ENJOIN ANY SALE OR OFFER FOR
SALE IN VIOLATION OF THIS SECTION BY APPLICATION TO A COURT OF
COMPETENT JURISDICTION.

(3)  ANY PERSON VIOLATING THE PROVISIONS OF THIS
SECTION IS GUILTY OF A MISDEMEANOR AND, UPON CONVICTION, IS
SUBJECT TO A FINE NOT EXCEEDING $2,000 OR IMPRISONMENT NOT
EXCEEDING 2 YEARS, OR BOTH, FOR EACH IDENTIFICATION CARD OR
DOCUMENT ISSUED SOLD OR OFFERED FOR SALE ISSUED, OR EACH OFFER
FOR SALE OR TO ISSUE IN VIOLATION OF THE PROVISIONS OF THIS
SECTION.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1988.
