AN ACT concerning
Health Planning - Certificate of Need
FOR the purpose of altering certain requirements for a
certificate of need issued by the Health Resources Planning
Commission relating to certain relocation, bed capacity,
service, and capital expenditure requirements under certain
circumstances; defining certain terms; maintaining certain
annual operating expenditure limits for certain health care
facilities which established a home health care service or
program without a certificate of need at a certain time;
providing for the consideration of the special needs and
circumstances of counties without certain services;
authorizing the Health Resources Planning Commission to
grant a certificate of need for a new medical service under
certain circumstances; allowing for certain donations of
equipment and plant to health care facilities without a
certificate of need; and generally relating to the
requirements for certificate of need.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

19-115.
(a) [In this section, "health care service" means any
clinically related patient service.] (1) IN THIS SECTION THE
FOLLOWING WORDS HAVE THE MEANINGS INDICATED.
(2) "HEALTH CARE SERVICE" MEANS ANY CLINICALLY
RELATED PATIENT SERVICE INCLUDING A MEDICAL SERVICE UNDER
PARAGRAPH (2) (3) OF THIS SUBSECTION.
(3) "MEDICAL SERVICE" MEANS EITHER A MEDICINE,
SURGERY, OBSTETRIC, PEDIATRIC, PSYCHIATRIC, COMPREHENSIVE
PHYSICAL REHABILITATION, OR COMPREHENSIVE CARE PROGRAM, INCLUDING
AN INTERMEDIATE CARE OR EXTENDED CARE PROGRAM:
