WILLIAM DONALD SCHAEFER, Governor Ch. 763

3-1104.

AS PROVIDED IN ARTICLE 41, § 4-103.1 OF THE CODE, THE
ATTORNEY GENERAL AND COUNSEL TO THE DEPARTMENT OF PUBLIC SAFETY
AND CORRECTIONAL SERVICES SHALL ASSIST A PAID FIRE DEPARTMENT, ON
REQUEST, IN THE NEGOTIATIONS AND IN THE FILING OF A COURT SUIT TO
OBTAIN REIMBURSEMENT UNDER § 3-1103 OF THIS SUBTITLE FOR THE
EXPENSE OF AN EMERGENCY RESPONSE, CONTAINMENT, CLEANUP, AND
ABATEMENT.

3-1105.

THIS SUBTITLE DOES NOT AFFECT ANY LIABILITY OR IMMUNITY OF A
PAID FIRE COMPANY, A PAID RESCUE SQUAD, OR THE PERSONNEL OF A
PAID FIRE COMPANY OR PAID RESCUE SQUAD UNDER § 5-309.1 OF THE
COURTS AND JUDICIAL PROCEEDINGS ARTICLE.

3-1105.

(A) IN THIS SECTION, "FARM VEHICLE" HAS THE MEANING STATED
IN § 13-911 OF THE TRANSPORTATION ARTICLE.

(B) THIS SUBTITLE DOES NOT APPLY TO A RELEASE OF HAZARDOUS
MATERIALS FROM A FARM VEHICLE THAT IS INVOLVED IN A TRAFFIC
ACCIDENT.

(C) THIS SECTION DOES NOT ABROGATE ANY STATUTORY OR COMMON
LAW RIGHT OR CAUSE OF ACTION OF A PERSON AGAINST THE OWNER OR
OPERATOR OF A FARM VEHICLE THAT HAS BEEN INVOLVED IN A TRAFFIC
ACCIDENT INVOLVING A RELEASE OF HAZARDOUS MATERIALS.

3-1106.

THIS SUBTITLE DOES NOT ABROGATE ANY STATUTORY OR COMMON LAW
RIGHT OR CAUSE OF ACTION OF A PERSON AGAINST A MOTOR CARRIER THAT
HAS SEEN INVOLVED IN A TRAFFIC ACCIDENT INVOLVING A RELEASE OF
HAZARDOUS MATERIALS.--------------------------------------------------

4-102.

(a) The following departments, agencies, boards,

commissions, offices, divisions, and units of the State

government are included within the Department of Public Safety
and Correctional Services: the State Emergency Management and
Civil Defense Agency established pursuant to § 4-105 of this
article, the Emergency Management Advisory Council, the Criminal

Injuries Compensation Board, the Division of Correction

established pursuant to § 4-105 of this article, the Patuxent
Institution, the Board of Patuxent Institution, the Board of
Review for Patuxent Institution, the State Fire Prevention
