SECTION 3. AND BE IT FURTHER ENACTED, That the provisions
of this Act apply only to a traffic accident involving hazardous
materials that occurs on or after July 1, 1988.
SECTION 4. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1988.

AN ACT concerning
Reimbursement for Costs of Emergency Response, Containment,
Cleanup, and Abatement - Transportation of Hazardous Materials -
Paid Fire Departments
FOR the purpose of requiring a motor carrier who transports
certain hazardous materials on a highway in the State and
who is at fault in and causes certain traffic accidents that
result in a spill or discharge of hazardous materials to
reimburse certain expenses of an emergency response,
containment, cleanup, and abatement by paid fire departments
and certain individuals; defining certain terms; providing
for the application of this Act to certain traffic accidents
that occur on or after the effective date of this Act;
providing that certain expenses of an emergency response,
containment, cleanup, and abatement under this Act are a
debt of the responsible motor carrier; requiring certain
negotiations under this Act; allowing certain parties to
file a court suit if the negotiations do not resolve certain
disputes; requiring the Attorney General and counsel to the
Department of Public Safety and Correctional Services to
provide certain assistance providing that this Act does not
apply to a release of hazardous material from farm vehicles;
specifying that this Act does not abrogate certain rights;
providing for the scope of this Act; providing for a certain
report under this Act; and generally relating to the
responsibility of a motor carrier who transports hazardous
materials that result in a spill or discharge of hazardous
materials to reimburse certain expenses.
