construction phases of certain capital construction projects
under certain circumstances; changing a certain requirement
for submitting preliminary plans and specifications;
requiring approval by the Department of State Planning of a
certain description of the scope of a capital project prior
to the authorization of funds for preliminary planning;
requiring approval by the Departments of State Planning and
General Services of a certain detailed design program prior
to the authorization of funds for construction; providing a
certain exception for any capital project funded by the
Transportation Trust Fund; and generally relating to the
process for approval and funding of capital construction
projects.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

5-101.

(D) "TOTAL PROJECT FUNDING" MEANS THE FUNDING FOR THE
PLANNING, DESIGN, CONSTRUCTION, AND EQUIPMENT OF A CAPITAL
PROJECT THROUGH A SINGLE APPROPRIATION OR AUTHORIZATION.

5-309.

(a)  The Department shall study each capital project
proposed by any unit of the State government.

(b)  Except for a capital project designated as an emergency
by the unit of the State government proposing the project, any
unit of the State government requesting a capital project shall
submit its request to the Department on or before June 30 of the
fiscal year preceding the fiscal year in which the capital
project is to begin.
