AN ACT concerning
Controlled Dangerous Substances and Alcohol Testing -
Laboratories - Licensing and Certification
FOR the purpose of requiring an employer who requires certain
job-related testing for the use or abuse of any controlled
dangerous substance or alcohol to have the specimen tested
by a laboratory that holds a certain permit or is certified
or approved in a certain manner; defining certain terms;
providing a certain exception certain exceptions; requiring
the employer to relate to the person being tested certain
information regarding the laboratory testing the specimen;
permitting an employee to request a certain independent
verification of the test results from the same sample;
requiring the Department of Health and Mental Hygiene to
adopt certain regulations for certification and approval of
certain laboratories; specifying a certain interpretation
for this Act; and generally relating to licensing and
certification of certain laboratories.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

17-214.1.
(A) IN THIS SECTION THE FOLLOWING WORDS HAVE THE MEANINGS
INDICATED.
(1) "ALCOHOL OR CONTROLLED DANGEROUS SUBSTANCE
TESTING" MEANS A PROCEDURE USED TO DETERMINE WHETHER OR NOT A
SPECIMEN CONTAINS A CONTROLLED DANGEROUS SUBSTANCE OR ALCOHOL.
(2) "CERTIFICATION" MEANS THE APPROVAL GRANTED BY THE
DEPARTMENT FOR A LABORATORY TO ENGAGE IN JOB-RELATED ALCOHOL OR
CONTROLLED DANGEROUS SUBSTANCE TESTING.
(3) "CONTROLLED DANGEROUS SUBSTANCE" HAS THE MEANING
STATED IN ARTICLE 27, § 277 OF THE CODE.
