2. AT LEAST 5 YEARS OF WORK IN THE FIELD
OF PUBLIC HEALTH; AND                                                       

(II) ANY OTHER QUALIFICATIONS AND TRAINING IN
THE FIELD OF PUBLIC HEALTH THAT THE SECRETARY REQUIRES BY RULE OR
REGULATION.

(3) THE DIRECTOR OF THE DEPARTMENT OF ADDICTION,

VICTIM, AND MENTAL HEALTH SERVICES NEED NOT BE A PHYSICIAN, IF
THE DIRECTOR HAS AN ASSOCIATE DIRECTOR WHO:

(I) IS A PHYSICIAN; AND

(II) MEETS THE QUALIFICATIONS OF THIS
SUBSECTION.

[(f)] (H) (1) "Mental disorder" means a behavioral or
emotional illness that results from a psychiatric or neurological
disorder.

(2)  "Mental disorder" includes a mental illness that
so substantially impairs the mental or emotional functioning of
an individual as to make care or treatment necessary or advisable
for the welfare of the individual or for the safety of the person
or property of another.

(3)  "Mental disorder" does not include mental
retardation.

[(g)] (I) "State Advisory Council" means the State Advisory
Council on Mental Hygiene.

[(h)] (J) "State facility" means a facility that is owned
or operated by the Department.

[(i)] (K) "Treatment" means any professional care or
attention that is given in a facility, private therapeutic group
home for children and adolescents, or Veterans' Administration
hospital to improve or to prevent the worsening of a mental
disorder.

SECTION 3. AND BE IT FURTHER ENACTED, That it is the intent
of this Act that in Montgomery County, the Director of the
Department of Addiction, Victim, and Mental Health Services shall
act in lieu of the county health officer for purposes of
implementing Titles 8, 9, and 10 of the Health - General Article.

SECTION 2 4. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1988.
