11-709. TRANSFER OF LICENSE.

EXCEPT AS OTHERWISE PROVIDED IN THIS SUBTITLE, A LICENSE MAY
NOT BE TRANSFERRED.

REVISOR'S NOTE: This section is new language derived
without substantive change from the first clause of
the third sentence of former Art. 81, § 362 and the
first clause of the third sentence of § 397.

11-710. DENIALS, REPRIMANDS, SUSPENSIONS, AND REVOCATIONS --
GROUNDS.

SUBJECT TO THE HEARING PROVISIONS OF § 11-711 OF THIS
SUBTITLE, THE COMPTROLLER MAY DENY A LICENSE TO ANY APPLICANT,
REPRIMAND ANY LICENSEE, OR SUSPEND OR REVOKE A LICENSE:

(1) IF THE APPLICANT OR LICENSEE:

(I) FRAUDULENTLY OR DECEPTIVELY OBTAINS OR
ATTEMPTS TO OBTAIN A LICENSE FOR THE APPLICANT OR LICENSEE OR FOR
ANOTHER; OR

LICENSE; OR

(II) FRAUDULENTLY OR DECEPTIVELY USES

(2) FOR CAUSE.

REVISOR'S NOTE: Item (1) of this section is new language
added to conform to almost all of the occupational
licensing acts adopted by the General Assembly in the
past several years. See, e.g., the comparable
sections on disciplinary actions in the various titles
of the Health Occupations Article. The General
Assembly expressly decided that the language of that
item was to be included in each of those sections as a
fundamental ground for disciplining a licensee.

Item (2) of this section is new language derived
without substantive change from the fourth sentence of
former Art. 81, § 397 and the fourth sentence of §
362, as they related to disciplinary actions.
