Article - Natural Resources

Section 5-1103 through 5-1108 5-1107, inclusive

Annotated Code of Maryland

(1983 Replacement Volume and 1987 Supplement)

Preamble

WHEREAS, The purpose of this Act is to encourage the owners
of land or water areas to make the airspace above the land or
water areas available to the public for hang gliding, hot air
ballooning, and operating light airplanes and other forms of
recreational aircraft by limiting the owners' liability toward
any person who enters on the airspace above the land or water
areas for that purpose; now, therefore,

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article - Natural Resources

5-1101.

(a)  In this subtitle[, the] THE following words have the
meanings indicated.

(b)  "Charge" means price or fee asked for services,
entertainment, recreation performed, or products offered for sale
on land or in return for invitation or permission to enter or go
upon land.

(c)  "Educational purpose" includes[, but is not limited to]
any of the following[, or] OR any combination of the following:
Nature study, farm visitations for purposes of learning about the
farming operation, practice judging of livestock, dairy cattle,
poultry, other animals, agronomy crops, horticultural crops, or
other farm products, organized visits to farms by school
children, 4-H clubs, FFA clubs and others as part of their
educational programs, and viewing historical, archaeological, or
scientific sites.

(d)  "Land" means land, roads, water, watercourses, private
ways and buildings, structures, and machinery or equipment when
attached to realty.

(e)  "Owner" means the possessor of a fee interest, tenant,
lessee, or person who possesses the premises.

(f)  "Recreational purpose" includes the following or any
combination of the following: Hunting, fishing, swimming,
