(V) RETURN THE STATE LICENSE.
(D) RESTRICTIONS.
(1) IF AN INDIVIDUAL OBTAINS A LOCAL LICENSE BY THE
USE OF THE STATE LICENSE OF THE INDIVIDUAL, THE LOCAL LICENSE MAY
BE ASSIGNED AT ANY 1 TIME TO ONLY 1 PERSON WHO ENGAGES IN THE
BUSINESS OF PROVIDING ELECTRICAL SERVICES.
(2) IF AT ANY TIME AN INDIVIDUAL HOLDS 2 OR MORE
CURRENT LOCAL LICENSES THAT WERE OBTAINED BY THE USE OF A STATE
LICENSE, THE INDIVIDUAL MAY ASSIGN THOSE LOCAL LICENSES ONLY IF
THE ASSIGNMENT IS MADE TO THE SAME PERSON.
COMMITTEE COMMENT: This section is new language substituted
for former Art. 56, § 531(d) and the first sentence of
§ 535(c). The substituted language provides for an
assignment of a local license, rather than a State
license, since the Committee believed that an
assignment is meaningful only when the license
assigned is a local license. A State license
authorizes the licensee to use it as a mechanism for
obtaining a local license. A local license allows a
licensee to provide electrical services. Except in
Allegany County, no right to provide electrical
services is granted under a State license.
The Committee also believed that a local jurisdiction,
not the State Board, has the responsibility for
determining whether a master electrician who assigns a
local license to a person under this subtitle is
"principally employed" by that person.
Similarly, the Committee believed that the issue of
the continuation of a person engaged in the business
of providing electrical services should be left to the
local jurisdiction where the licensee is employed.
Accordingly, former Art. 56, § 540(h), which allowed
for continuation of a business after the death of the
State licensee, is deleted.
In the introductory language of subsection (a) of this
section, the reference to an individual who "qualifies
for a State license" is added to clarify that, at the
time of applying for a State license, an applicant may
seek to obtain or assign a local license.
In subsections (a)(2), (b), and (d) of this section,
the defined term "engag{e} in the business of
providing electrical services" is used to conform to
the interpretation of the Department that an
assignment of a license may be made only to a
business.
