WILLIAM DONALD SCHAEFER, Governor Ch. 648

corporation" seemed to suggest that a licensed master
electrician could permit another "person, firm, or
corporation", if licensed, to provide electrical
services. However, this title only provides for the
licensure of an individual, as opposed to licensing a
business entity that provides electrical services.
The assignment of the master electrician's license to
a business does not confer licensing status on the
business. No one, other than a master electrician,
may be issued a license under this title.

Defined terms: "Local license" § 2-101
"Person" § 1-101 "State Board" § 2-101
"State license" § 2-101

2-317. HEARINGS.

(A)  RIGHT TO HEARING.

EXCEPT AS OTHERWISE PROVIDED IN TITLE 10, SUBTITLE 4 OF THE
STATE GOVERNMENT ARTICLE, BEFORE THE STATE BOARD TAKES ANY FINAL
ACTION UNDER § 2-316 OF THIS TITLE, IT SHALL GIVE THE INDIVIDUAL
AGAINST WHOM THE ACTION IS CONTEMPLATED AN OPPORTUNITY FOR A
HEARING BEFORE THE STATE BOARD.

(B)  APPLICATION OF CONTESTED CASE PROVISIONS.

THE STATE BOARD SHALL GIVE NOTICE AND HOLD THE HEARING IN
ACCORDANCE WITH TITLE 10, SUBTITLE 2 OF THE STATE GOVERNMENT
ARTICLE.

(C)  FAILURE OR REFUSAL TO APPEAR.

IF, AFTER DUE NOTICE, THE INDIVIDUAL AGAINST WHOM THE ACTION
IS CONTEMPLATED FAILS OR REFUSES TO APPEAR, NEVERTHELESS THE
STATE BOARD MAY HEAR AND DETERMINE THE MATTER.

COMMITTEE COMMENT: Subsections (a) and (b) of this section

are new language derived from the introductory

language of former Art. 56, § 539(a), as it related to
hearings.

Subsection (c) of this section is new language added
to clarify that, after the accused individual has been
given proper notice, the State Board may proceed with
a hearing even if the individual fails to appear.

In subsection (a) of this section, the introductory
exception is new language added to clarify that the
State Board summarily may take action against an
individual under certain circumstances. See SG §
10-405(b).
