COMMITTEE COMMENT: Subsections (a) and (b)(1) and (2) of
this section are new language derived from the seventh
sentence and the first clause of the eighth sentence
of former Art. 56, § 534(c). Its revision is
patterned after the standard language now used
throughout the revised articles of the Code for
provisions that allow or require waiver of
examination.
Subsection (b)(3) of this section is new language
added to conform to the current practice of the State
Board to request a local jurisdiction to certify
certain licensing information.
Subsection (c) of this section is new language added
to reflect the belief of the Committee that an
individual who obtains a State license on the basis of
a waiver under this section should be required to
maintain that license. Thus, if the individual fails
to maintain the State license, the individual is
required to meet the requirements for licensure.
In subsection (b) of this section, the references to
"local jurisdiction" are substituted for the former
reference to a "local electrical licensing board", to
reflect licensure by a local entity other than a local
board.
Also in subsection (b) of this section, the former
reference to local jurisdiction as being "certified"
by the State Board if the jurisdiction has equivalent
licensing requirements and administers an equivalent
examination is deleted as misleading and unnecessary
in light of subsection (b)(2)(ii) of this section. In
practice, the State Board does keep a list of local
boards that have equivalent licensing requirements and
give equivalent examinations. However, the focus of
the inquiry of the State Board is on the
qualifications of the applicant for waiver as opposed
to a system of certification for local boards.
In subsection (b)(2)(ii)l. of this section, the
reference to "passing ... an examination that is
equivalent" is substituted for the former reference to
"successfully completed a certified examination", for
clarity. In practice, the State Board certifies a
local examination if it is equivalent to the State
examination for which the applicant is seeking a
waiver.
